Doctor Saud al-'Ajaaji who was amongst those who accompanied Shaykh al-'Uthaymeen on the last medical trip he made to Boston (a city in America) said, “Whilst we were leaving the hotel where we were staying in, a little American boy who was with his mother stood in front of him - the Shaykh caught his attention because of his Saudi thawb and abayah - so he began to touch him on his head and to play with him. So his mother asked him to greet the Shaykh and he returned an even better greeting. Then the Shaykh said directing his speech to the mother 'May Allaah guide you to Islaam' all during which he kept lowering his gaze. Then the mother told her son to bid the Shaykh farewell by saying to her son, 'Tell him have a nice day.' So the Shaykh asked me what he said, I told him he said ‘Have a nice day.’ However some of those who were accompanying him became annoyed because of the way in which the woman was dressed. One of them even made some remarks towards her, but the Shaykh did not like this and he said, 'O brothers this is not from the mannerisms of Islaam, the mother and he son were smiling at us and they were very cordial in speech, so it is upon us to reciprocate the favour. [Q]: One of the brothers who lives in Riyadh says, “It is well known that boycotting one's Muslim brother for more than three days is impermissible. Hence what is the ruling regarding regarding what occurs between the husband and his wife as far as boycotting is concerned whether or not he intends to discipline her or otherwise?” [A]: The husband boycotting his wife is legislated for specified circumstances, and that is when he fears her disobedience (nushooz). Thus is that case he admonishes her and if that does not work then he boycotts her in the bed. This does not mean that he sleeps in another bed other than the one they both sleep in, rather what is meant is that whenever he sleep in his bed, he should turn his back towards her. Hence he sleeps with his back towards her as an indication of his anger towards her and his reprimanding of her. However he should not boycott her as far as speaking is concerned. Thus the children should not get a sense of cold-heartedness or a lack of communication between their father and their mother. That should only occur in the bed with intent of rectifying her incorrect behaviour. However that does not mean that if the wife does not respond to the request of the husband from the things that are not obligatory on her he boycotts her. Because sometimes the shortcoming stems from the husband himself when he wants his wife to do things she is either incapable of doing, or is very difficult for her, or it is an act that impermissible to do. If she does not do these things he boycotts her. No. Boycotting is only legislated if he sees nushooz, disobedience from her, or an act that is clearly incorrect. As for making that a weapon that he uses to get at her or humiliate her, then this is impermissible. Some people understand the issue of boycotting – even in bed – with an incorrect understanding. The hadeeth (prophetic statement) begins with a sermon that caused the Companions of the Prophet to weep and their hearts to tremble. They thought that Allaahs Messenger was about to leave them, so they sought his advice and counsel. The Messenger of Allaah, may the peace and blessings of Allaah be upon him, further explains that over time differing and controversy will occur between the Muslims. He mentions to them the cure to this differing and separation, that is: Stick to my Sunnah and the Sunnah of the Rightly Guided Caliphs after me. He continued: Hold on to that with your molar teeth. The Messenger, may the peace and blessings of Allaah be upon him, warned the Muslims from innovating in matters of worship in this hadeeth: Be warned of the newly invented matters for verily every newly invented matter is an innovation and every innovation is misguidance, and to obey the Muslim rulers: I advise you with the fear of Allaah and to hear and obey (your leaders) even if an Abyssinian slave were to rule over you. The hadeeth is beautifully explained by the Scholar and former teacher at the Islamic University of Madinah, Shaikh Ubayd Al-Jaabiree and it has compiled and presented to you in this book.  |
