Is it permissible to not perform an Islamic marriage because the law in a non Muslim land force Muslims to perform a civil marriage before an Islamic marriage? In this case the two people were married, the woman
live with a mentally abusive non Muslim mother, the way man isn't active in the Muslim community because of her autism and behavior issues in the community among the women and herself. The man is planning to travel to her country but not soon. They have been trying to get marry for 6 months but no help from people in either of their communities. They need to know if her wali is unfit and should be replaced then find a suitable wali in the man's community?

The conditions of the marriage, according to the sharʿiah, must be met. How would the local civic authorities know that the nikah has been made? If the two people were married according to Islām, then conduct a civic registration (for the sake of the local government paperwork), then let them do that in shāʾ Allāh.
